I may also like to draw your attention to the fact that my statement has also been earlier corroborated by some of the Members representing Mumbai. They have also agreed, as far as I understand them, that there had been perpetration of police excesses.
So far as the Government here is concerned, the hon. Home Minister had made a statement. In that statement also, he has not tried to conceal the state of affairs and the immensity of the atrocities or the immensity of the police excesses. I would like to refer to certain paragraphs of the hon. Home Minister's statement. He said:
"However, the fact remains that the act of desecration of the statue of Dr. Ambedkar and subsequent police firing resulted in several deaths and injuries is extremely disturbing."
I asked the hon. Members to know their reaction. I again would like to draw your attention to the eleventh paragraph of the hon. Home Minister's statement where he said:
"Even as the State Government will hopefully bring the criminals to book and prevent the recurrence of such incidents, Members would agree that incidents such as the one in Mumbai are indeed a matter of great concern."
The question still remains whether Article 356 should be applied or not. In this case, the Government as of today is seriously considering the application of Article 356. More than one hundred times, Article 356 has been used. I know that Shri Banatwalla has also joined us in our voice to say that in most of the cases Article 356 has been misused, and misused for the partisan interests of the ruling parties at the Centre. Therefore, we really want that the misuse should not be repeated and that the misuse of Article 356 is to be ended.
Sir, you may not agree with this, insofar as Bihar is concerned. But Bihar is not the only State nor Mumbai is the only place about which we are worried; apart from Bihar, there is this rest of the country. You cannot impose bureaucracy; you cannot impose autocracy; you cannot negate the democratic rights of the rest of the country simply because something happened in Mumbai or in Patna which is undesirable. However, we can separately deal with the issues of Mumbai and Patna. Sir, you will also agree with me that the misuse of that Article is to be ended. Therefore, we should be very cautious to recommend for the application of Article 356.
I am coming to the other part of my speech now.
Now, let us understand that recent years have witnessed waves of unrest, protest and awareness among the Dalits. Somebody may say that it is a danger to social stability. Some may not like it. But I differ with them. I take that this awakening of the Dalits, this awakening of the most under-privileged section of our society, down-trodden segment of our society, constitutes the overwhelming majority of our country. If you go into the statistics, you will find, which I will not indulge in, the awareness about the identity of the Dalits. What are they struggling for and what are they asking for? They are asking for their social identity. Every man and woman in this country have got the right to protect, preserve and enhance his or her identity. If it is not a crime for other segments of the society, it cannot be a crime or sin for the Dalits. Dalits have also the right to search for their identity, to struggle for the preservation of their self-respect and I support it. There are some segments of society who do not like it and who always want that Dalits should ever remain Dalits, socially, economically, educationally and politically. This is the result of that. We shall have to consider this aspect of Dalit uprising.
You know that Dalit consciousness, which I will consider as collective consciousness, represent an overwhelming majority. Dalit consciousness is an aggregate of the consciousness of the Dalits, Scheduled Castes, Scheduled Tribes, other backward communities and the minorities. Further, the Constitution of our country realised the very basics of historical dynamism. Therefore, in their wisdom, they offered certain privileges which I call or characterise as positive discrimination. They have been exposed to ruthless exploitation for ages and decades together. They should be compensated for and for that, there are certain articles enshrined in the Constitution of our country which we call in our political parlance as affirmative discrimination. I know that there are certain segments of our society which call it an indiscrimination. They call the Government's position or the constitutional position as offensive to them, as inimical to them and this raises a conflict between the collective consciousness of the depressed and the consciousness of a few to perpetuate their rule, their predominance, their economy, politically and socially. If we view the Dalit uprising from that point of view, many of the problems which we are suffering from can be resolved.
Regarding discussion of statues, some of the very distinguished hon. Members of the House have said that many statues are built or erected but are not properly maintained. Even birds do nuisance on their heads. It is true but that does not explain the responsibility of the society, of the Government and of those who are there to enforce law and order.
The desecration of the statue of Dr. Bhimrao Ambedkar is nothing but an affront against the Dalits. This is nothing but an insult to the Constitution of our country. This is nothing but a body-blow to the sense of self-respect and dignity of the collective consciousness of the Scheduled Castes, Scheduled Tribes and the minorities along with those saner sections of society which have an abiding faith in secular democracy. Therefore, I cannot but condemn, with all the emphasis at my command, and protest against this anti-social activity. I think, the entire House would join me in condemning these anti-social activities. The Governments of all the States should also be aware of this emotion of the people.
